Watson, Chairperson HEARING DATE: RECOMMEND: CONSENT CALENDAR STAFF ANALYSIS OF SENATE BILL 1360 (HEALTH & HUMAN SERVICES COMMITTEE) AS Introduced IN SENATE MAY 8, 1995 SUBJECT Health and Safety Code: Recodification INTENT This bill seeks to simplify the Health and Safety Code. ABSTRACT Arranges all current law provisions of the California Health and Safety Code (HSC) relating to public health into seven new sections. They are as follows: 101-Administration of Public Health 102-Vital Records and Health Statistics 103-Disease Prevention and Health Promotion 104-Environmental Health 105-Communicable Disease Prevention and Control 106-Personal Health Care 107-Statewide Health Planning and Development Renumbers the Code sections into multiples of five to allow for future additions and revisions. Declares the legislatureos intent to reorganize and clarify portions of the Health and Safety Code, and thereby facilitate its administration. Also, declares that this act would have only technical and nonsubstantive effect. STAFF ANALYSIS OF SB 1360 (HEALTH & HUMAN SERVICES COMM.)Page 3 BACKGROUND AND DISCUSSION Existing law, Chapter 611, Statutes of 1991 (AB 1491/Bronzan) requires the State Department of Health Services to conduct a comprehensive review of the statutes relating to public health and to recodify the Health and Safety Code. AB 1491 was one of two bills that was intended to be a vehicle for the realignment of health services during the 1991-92 legislative session. The first bill, Chapter 89, Statutes of 1991 (AB 1288/Bronzan), was signed by the governor, but was canceled out by the provisions of AB 1491. This bill is the product of a year-long collaborative effort between health officials at various levels of the public and private sector. Participates include: State Department of Health Services, local health enforcement agencies, the Legislative Counselos office, and a Recodification Task Force with prescribed members. SB 1360 is an entirely technical bill that would make no substantive, policy changes. According to the Department, SB 1360 represents parts I and II of a three- part effort to recodify the Health and Safety Code. In addition, it would reorganize existing law into a better framework that is updated and easy-to-use. Statutes unrelated to public health would remain in their current format.
