Committee) - As Introduced: May 8, 1995 SENATE ACTIONS: COMMITTEE H. & H. S. VOTE 6-0 FLOOR VOTE 38-0 SUBJECT Should the existing State Health and Safety Code be recodified? DIGEST Existing law distributes functions governing public health and related administrative functions throughout the Health and Safety Code. This bill: 1) Arranges all current law provisions of the California Health and Safety Code (HSC) relating to public health into seven new divisions as follows: 101-Administration of Public Health 102-Vital Records and Health Statistics 103-Disease Prevention and Health Promotion - continued - SB 1360 Page 1 SB 1360 104-Environmental Health 105-Communicable Disease Prevention and Control 106-Personal Health Care 107-Statewide Health Planning and Development 2) Renumbers the code sections into multiples of five to allow for future additions and revisions. 3) Declares the Legislature's intent to reorganize and clarify portions of the Health and Safety Code, and thereby facilitate its administration. Also, declares that this act would have only technical and nonsubstantive effect. FISCAL EFFECT None COMMENTS 1) NEED FOR THE BILL. Existing law, Chapter 611, Statutes of 1991 (AB 1491, Bronzan) requires the State Department of Health Services to conduct a comprehensive review of the statutes relating to public health and to recodify the Health and Safety Code. AB 1491 was one of two bills used as vehicles for the realignment of state and local responsibilities for health services during the 1991-92 legislative session. This bill is the product of a year-long collaborative effort between health officials at various levels of the public and private sectors. Participants included: the State Department of Health Services, local health enforcement agencies, Legislative Counsel's office, and a Recodification Task Force with prescribed members. SB 1360 is an entirely technical bill that would make no - continued - SB 1360 Page 2 SB 1360 substantive, policy changes. According to the Department, SB 1360 represents parts I and II of a three-part effort to recodify the Health and Safety Code. In addition, it would reorganize existing law into a better framework that is updated and easy-to-use. Statutes unrelated to public health would remain in their current format. 2) PROSPECTIVE CLEANUP. This bill recodifies the Health and Safety Code as of the end of 1993. Cleanup legislation will thus be required to recodify 1994 and 1995 legislation keyed to the sections this bill amends. SPONSOR: Department of Health Services.
