BILL SUMMARY: 

AB 513 adds manufacture of large amounts of methamphetamine  
(meth), amphetamine, or phencyclidine (PCP) to the list of  
offenses that are eligible for sentence enhancements of 3 to 15  
years.

STAFF COMMENTS:  This bill probably meets the criteria to be  
placed on the Suspense File. 

Under current law, sale, transportation, importation, furnishing,  
or possession for sale of meth, amphetamine, or PCP is punishable  
by imprisonment in state prison for 16 months to 9 years.  If the  
offense involves a olarge amounto, it is subject to a sentence  
enhancement of 3 to 15 years.  This enhancement does not apply to  
the  manufacture  of large amounts.  The manufacture of any  
controlled substance is punishable by 3, 5, or 7 years in state  
prison.   This bill provides that the manufacture of large amounts  
of those substances is subject to the sentence enhancement.  

According to CDC, there were 956 prison admissions for 1995-96 for  
manufacture of a controlled substance.  For every 10%, or 96  
persons, serving additional time in state prison for manufacture  
of controlled substances in large amounts, assuming an average  
sentence enhancement of 7.5 years, increased incarceration costs  
would be about $1.03 million annually beginning 2002-03.
