LEGISLATIVE COUNSEL'S DIGEST SB 2003, as amended, Speier. Transportation: rapid commuter rail: funding. Existing law requires federal and state funds available for state, regional, and local transportation projects to be expended in accordance with a specified sequence of priorities. This bill would appropriate$217,000,000$127,000,000 from the General Fund to the Department of Transportation for allocation to the governing board of the Peninsula Corridor Joint Powers Board for the purpose of establishing rapid commuter rail service between the City and County of San Francisco and the City of San Jose, as specified, and between the City of Stockton and an area that includes the mid-San Francisco peninsula, and the City of San Jose, as specified. The bill would make the allocation for the latter route contingent on the provisions of evidence of funding, as specified, for operating expenses for service over that route being provided to the Director of Transportation by the governing board of the Peninsula Corridor Joint Powers Board and specified transit agencies. Vote: 2/3. Appropriation: yes. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. The sum oftwo hundred seventeenone hundred twenty-seven million dollars($217,000,000)($127,000,000) is appropriated from the General Fund to the Department of Transportation for allocation to the governing board of the Peninsula Corridor Joint Powers Board, a joint powers agency duly formed pursuant to Article 1 (commencing with Section 6500) of Chapter 5 of Division 7 of Title 1 of the Government Code, by and between the San Mateo County Transit District, the Santa Clara Valley Transportation Authority, and the City and County of SanFrancisco, for the following purposes: (a) ToFrancisco, to establish rapid commuter rail service between the City and County of San Francisco and the City of San Jose. For the purposes of thissubdivisionsection , establishment includes, but is not limited to, construction of any required additional track, construction of any required upgrades to existing track, construction of an additional pedestrian access structure at the Millbrae station, and, if needed, at other stations where rapid commuter rail service trains will stop, and acquisition of any required equipment.(b) (1) Except as provided in paragraph (2), to establish rapid commuter rail service between the City of Stockton and an area that includes the mid-San Francisco peninsula, and the City of San Jose. For the purposes of this subdivision, establishment includes, but is not limited to, any construction required on the Dumbarton rail bridge, construction of any required additional track, construction of any required upgrades to existing track, and acquisition of any required equipment. (2) The Department of Transportation may not make an allocation for the purpose described in paragraph (1) unless the governing board of the Peninsula Corridor Joint Powers Board provides evidence, that the Director of Transportation determines to be sufficient, that funding for operating expenses for service over the route described in paragraph (1) will be provided if the money is allocated for that route. Evidence of funding may include memorandums of understanding between the governing board and one or more transit agencies indicating that operating expenses will be provided by the signatory agencies, or any other evidence the Director of Transportation determines to be acceptable.
