LEGISLATIVE COUNSEL'S DIGEST SB 301, Committee on Rules. Secretary of Senate and Chief Clerk of Assembly: notarial duties. Existing law provides for the appointment and commission of notaries public and authorizes specified public officers and officials to perform services performed by notaries public relating to the acknowledgment and proof of execution of instruments. Existing law also provides for the offices of Secretary of the Senate and the Chief Clerk of the Assembly and authorizes those officers to administer and certify oaths. This bill would authorize the Secretary of the Senate and the Chief Clerk of the Assembly to perform the services of acknowledgment and proof of execution of instruments in accordance with the provisions of law governing the performance of notarial services by public officers. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 1180 of the Civil Code is amended to read: 1180. The proof or acknowledgment of an instrument may be made at any place within this state before a justice, retired justice, or clerk of the Supreme Court, a justice, retired justice, or clerk of any court of appeal or judge or retired judge of a superior court, or the Secretary of the Senate or Chief Clerk of the Assembly. SEC. 2. Section 1181 of the Civil Code is amended to read: 1181. The proof or acknowledgment of an instrument may be made before a notary public at any place within this state, or within the county or city and county in this state in which the officer specified below was elected or appointed, before either: (a) A clerk of a superior or municipal court. (b) A county clerk. (c) A court commissioner. (d) A judge or retired judge of a municipal or justice court. (e) A district attorney. (f) A clerk of a board of supervisors. (g) A city clerk. (h) A county counsel. (i) A city attorney. (j) Secretary of the Senate. (k) Chief Clerk of the Assembly. SEC. 3. Section 9191.5 of the Government Code is amended to read: 9191.5. The Secretary of the Senate and Chief Clerk of the Assembly may administer and certify oaths and may provide the proof or acknowledgment of an instrument in accordance with Article 3 (commencing with Section 1180) of Chapter 4 of Part 4 of Division 2 of the Civil Code.
