LEGISLATIVE COUNSEL'S DIGEST AB 1905, Rod Pacheco. District accounts: authorization. Existing law authorizes local park and recreation districts to operate and maintain local parks and recreation areas in the state. Tax revenues of the district are required to be placed in the treasury of the city or county in which the district is located, and the treasurer of that city or county acts as the treasurer of the district. This bill would authorize a recreation and park district to establish an alternative depositary pursuant to specified provisions applicable to community services districts, with the approval of the city or county in which the district is located. This bill would revise the alternative depositary provisions applicable to community services districts to permit the finance director of the district board to be the general manager. The bill would permit warrants to be drawn by the president and the general manager of the district board. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 61737.04 of the Government Code is amended to read: 61737.04. The board shall appoint a person who shall be known as the finance officer, who shall serve at its pleasure. It shall fix the amount of his or her compensation. It shall fix the amount of and approve his or her bond. The finance director may be a member of the board, the general manager, or his or her office may be consolidated with that of the secretary. SEC. 2. Section 61737.06 of the Government Code is amended to read: 61737.06. Warrants shall be drawn by the finance officer and signed by the president and secretary, or one of them and one member of the board, or by the president and the general manager. SEC. 3. Section 5782.5.1 of the Public Resources Code is repealed. SEC. 4. Section 5784.40 is added to the Public Resources Code, to read: 5784.40. Notwithstanding Sections 5784.18 and 5784.19, with the prior approval of the supervising authority, a district may establish an alternative depositary pursuant to Chapter 6.1 (commencing with Section 61737.01) of Part 5 of Division 3 of Title 6 of the Government Code.
