LEGISLATIVE COUNSEL'S DIGEST AB 2221, Battin. Vehicles: golf carts. (1) Existing law authorizes, until January 1, 2001, any city or county to establish a golf cart transportation plan establishing golf cart lanes, as defined, for the travel of golf carts on roadways designated in the plan. Existing law prohibits any person from operating a golf cart on any highway except in a speed zone of 25 miles per hour or less. Among other exceptions to that prohibition is, until January 1, 2001, a person operating a golf cart in a golf cart lane that is part of a golf cart transportation plan. This bill would delete the January 1, 2001 repeal dates specified above, thereby continuing, indefinitely the authority to establish a golf cart transportation plan. Because violations of certain provisions that the bill would thus extend are infractions, the bill would impose a state-mandated local program by extending indefinitely the duration of existing crimes. (2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 1967 of the Streets and Highways Code is repealed. SEC. 2. Section 21716 of the Vehicle Code, as amended by Section 13 of Chapter 536 of the Statutes of 1997, is amended to read: 21716. Except as provided in Section 21115.1 and Chapter 6 (commencing with Section 1950) of Division 2.5 of the Streets and Highways Code, no person shall operate a golf cart on any highway except in a speed zone of 25 miles per hour or less. SEC. 3. Section 21716 of the Vehicle Code, as amended by Section 4 of Chapter 536 of the Statutes of 1997, is repealed. SEC. 4. No reimbursement is required by this act pursuant to Section 6 of Article XIIIB of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIIIB of the California Constitution.
