LEGISLATIVE COUNSEL'S DIGEST AB 1395, Correa. Public works: prevailing wages. Existing law requires that, except for public works projects of $1,000 or less, not less than the general prevailing rate of per diem wages for work of a similar character in the locality in which the public work is performed, and not less than the general prevailing rate of per diem wages for holiday and overtime work, as provided in specific provisions, be paid to all workers employed on public works. Under existing law, the Division of Labor Standards Enforcement of the Department of Industrial Relations is authorized to conduct investigations to determine if the prevailing wage provisions have been violated. This bill would require the Division of Labor Standards Enforcement, during an investigation, to keep confidential the name of any employee who reports a violation and any other information that may identify the employee. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 1736 is added to the Labor Code, to read: 1736. During any investigation conducted under this part, the Division of Labor Standards Enforcement shall keep confidential the name of any employee who reports a violation of this chapter and any other information that may identify the employee.
