LEGISLATIVE COUNSEL'S DIGEST AB 290, Steinberg. Design-Build: Leland Stanford State Historical Park. Existing law vests control of the state park system in the Department of Parks and Recreation, which includes various parks and facilities. This bill would authorize the Director of Parks and Recreation to contract for the construction for the preservation and restoration of the Leland Stanford Mansion State Historical Park and related facilities using a design-build process that the Director of General Services is authorized to use. The bill would establish additional requirements for the design-build process. The bill would incorporate a provision of existing law that provides that a person who certifies as true any material matter that he or she knows to be false is guilty of a misdemeanor. By changing the definition of an existing crime, the bill would impose a state-mandated local program. The bill would require the director to submit a report to the Joint Legislative Budget Committee as specified. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Article 3 (commencing with Section 5080.50) is added to Chapter 1.2 of Division 5 of the Public Resources Code, to read: Article 3. Leland Stanford Mansion State Historical Park Construction 5080.50. Notwithstanding any provision of law to the contrary, the Director of Parks and Recreation may contract for construction for the preservation and restoration of the Leland Stanford Mansion State Historical Park and related facilities using the design-build process set forth in Section 14661 of the Government Code. 5080.51. The director is authorized to use the method for selection of the design-build entity set forth in clause (i) of subparagraph (A) of paragraph (3) of subdivision (d) of Section 14661 of the Government Code, notwithstanding that the approved project budget may not be ten million dollars ($10,000,000) or more. 5080.52. In addition to the requirements set forth in paragraph (1) of subdivision (d) of Section 14661 of the Government Code, the program required by this article may include, but is not limited to, the following: (a) The size, type, and desired or required historic and other design character and features of the buildings and site. (b) Performance specifications covering the historic or other nature and quality of materials, equipment, and workmanship. (c) A project cost estimate, including a factor for contingencies. (d) A proposed design and construction schedule showing the critical path of work for both working drawings and construction and all state approvals. (e) Any other information deemed necessary to describe adequately the state's needs. The project cost estimate and the proposed design and construction schedule shall be prepared by a design professional duly licensed and registered in this state. 5080.53. The director may accept donations of services, including architectural, engineering, construction management, or other professional services, construction labor and materials, or any other donations, in addition to donations of funds to be integrated into the project on terms and conditions that, in the discretion of the department, will contribute to the successful prosecution and completion of the restoration and preservation project. The director may, in addition to any other criteria authorized by Section 14661 of the Government Code, include the donation of goods and services as a basis for selection for the design-build entity. 5080.54. In addition to the approvals required by Section 13332.19 of the Government Code, prior to advertising for design-build proposals, the director shall submit to the State Public Works Board the program required by paragraph (1) of subdivision (d) of Section 14661 of the Government Code and Section 5080.52 of this code and shall obtain from the board approval of the scope and cost for the project. 5080.55. Notwithstanding Section 7550.5 of the Government Code, the director shall submit a report containing the program required by paragraph (1) of subdivision (d) of Section 14661 of the Government Code and Section 5080.52 of this code to the Joint Legislative Budget Committee for review and comment not less than 30 days prior to advertising for the submittal of design-build proposals for the project. In addition to any other requirements for the program contained in paragraph (1) of subdivision (d) of Section 14661 of the Government Code and Section 5080.52 of this code, the report shall contain the criteria, including the relative weight to be assigned to the criteria, to be used for the evaluation of the design-build proposals and selection of the design-build entity. 5080.56. Notwithstanding Section 10 of Chapter 66 of the Statutes of 1999, the director shall contract with the Department of General Services or a mutually agreeable private contractor to provide assistance with project management and oversight of the project. Independent professional services contracts may be entered into for inspection services, construction management services, or any other services necessary for proper administration of the project. SEC. 2. No reimbursement is required by this act pursuant to Section 6 of Article XIIIB of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIIIB of the California Constitution.
