I am signing Assembly Bill No. 756, however I am reducing the following item: Item 3790-302-001--for relocation and restoration of Stilwell Hall in Monterey County, and for the stabilization and restoration of the Copperopolis Armory in Calaveras County. I reduce this item from $3,020,000 to $3,010,000 by deleting the funding for Copperopolis Armory. This appropriation inappropriately diverts funding intended for high priority state park cultural heritage projects to a local project. This project should be funded from local resources. The other budgetary augmentations and reallocations provided for in this bill are appropriate expenditures and have my full support. GRAY DAVIS, Governor LEGISLATIVE COUNSEL'S DIGEST AB 756, Keeley. Budget Act of 1999: augmentation. Existing law, as set forth in the Budget Act of 1999, makes various appropriations for support of state government for the 1999-2000 fiscal year. In augmentation of the Budget Act of 1999, this bill would reappropriate $3,010,000 from support of the Department of Parks and Recreation for cultural heritage projects to support of relocation and restoration of Stilwell Hall at Fort Ord and for stabilization and restoration of the Copperopolis Armory, as specified. The bill would appropriate $8,000 from the General Fund to the Department of Fish and Game for the New Hogan Lake Conservancy, as specified. The bill would also appropriate $235,000 from the General Fund to the Department of Water Resources to pay the Reclamation Board's share of preconstruction engineering and design costs relating to the Success Reservoir Enlargement Project. The bill would reappropriate $6,000,000 to the Department of Water Resources for expenditure without regard to fiscal years for various local assistance projects. The bill would declare that it is to take effect immediately as an urgency statute. Appropriation: yes. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. The appropriations made by this act are in augmentation of the appropriations made in Section 2.00 of the Budget Act of 1999 (Ch. 50, Stats. 1999) and are subject to the provisions of that act, as appropriate, including, as applicable, the provisions of that act that apply to the items of appropriation that are augmented by this act. The references in this act to item numbers refer to items of appropriation in Section 2.00 of the Budget Act of 1999. SEC. 2. Of the amount appropriated for cultural heritage projects in Item 3790-002-0001, three million ten thousand dollars ($3,010,000) is hereby reappropriated in augmentation of the appropriation made in Item 3790-302-0001, to be used by the Department of Parks and Recreation for relocation and restoration of Stilwell Hall in Monterey County to preserve this important cultural resource, and for stabilization and restoration of the Copperopolis Armory in Calaveras County to preserve this important cultural resource in accordance with the following schedule and provisions: Schedule: (2.5) 90.D8.100-Stilwell Hall at Fort Ord: Relocation and Res- toration ...................... 3,010,000 (2.7) Copperopolis Armory: Sta- bilization and Restoration .... 10,000 Provisions: 2. Expenditure of funds appropriated in Sched- ule (2.5) is contingent upon a minimum fed- eral match of$2,990,000 and docu- mentation demonstrating that the balance of funding necessary to complete the project has been provided from nonstate sources. 3. The funds appropriated in Schedule (2.5) of this item are available for encumbrance for capital outlay, local assistance, or payment to the federal government through the 2001-02 fiscal year. SEC. 3. Eight thousand dollars ($8,000) is hereby appropriated from the General Fund in augmentation of the appropriation made in Item 3600-102-0001, to be used by the Department of Fish and Game, for the New Hogan Lake Conservancy in Calaveras County, in accordance with the following schedule and provisions: Schedule: (2) 20.01-Calaveras County: New Hogan Lake Conservancy ......... 8,000 SEC. 4. The sum of two hundred thirty-five thousand dollars ($235,000) is hereby appropriated from the General Fund to the Department of Water Resources to pay the Reclamation Board's share of preconstruction engineering and design costs relating to the Success Reservoir Enlargement Project. SEC. 5. (a) The amount appropriated in Schedule (b) of Item 3860-101-0001 is hereby reappropriated to the Department of Water Resources for expenditure without regard to fiscal years for the following local assistance: (1) Three million dollars ($3,000,000) shall be used for the delta levee maintenance program under Part 9 (commencing with Section 12980) of Division 6 of the Water Code. (2) Three million dollars ($3,000,000) shall be used for special flood control projects under Chapter 2 (commencing with Section 12310) of Part 4.8 of Division 6 of the Water Code, subsidence studies and monitoring, and costs of administration for flood protection projects on Bethel, Bradford, Holland, Hotchkiss, Jersey, Sherman, Twitchell, and Webb Islands and at other locations in the Sacramento-San Joaquin Delta, as described in Section 12220 of the Water Code. (b) Of the funds reappropriated pursuant to subdivision (a), not more than 5 percent may be expended to repair levee road pavement if the damage is attributable to flood control maintenance. (c) Any funds that are made available under subdivision (a) may be used to reimburse local agencies for the state's share of costs for eligible projects completed on or after July 1, 1998. (d) The expenditure of funds reappropriated by this section is subject to Chapter 1.5 (commencing with Section 12306) of Part 4.8 of Division 6 of the Water Code. (e) The funds reappropriated pursuant to this section may only be expended consistent with the procedures prescribed in Section 78543, 78544, and 78545 of the Water Code. SEC. 6. This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are: In order to make certain necessary augmentations to the appropriations made by the Budget Act of 1999 for support of state government for the 1999-2000 fiscal year, it is necessary that this act take effect immediately.
