LEGISLATIVE COUNSEL'S DIGEST SB 938, Solis. Alternative payment programs. Existing law provides for child care alternative payment programs, the purpose of which is to provide for parental choice in child care. Under existing law, alternative payment programs may provide payment to child care facilities with a majority of subsidized children if there is a lack of licensed child care facilities in the area, the facility is able to meet the special needs of a particular child, or for any other reason authorized by regulation. This bill would instead authorize alternative payment programs to provide payment to child care facilities with 75% or more subsidized children, if at least one of the conditions required by existing law is met. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 8222.5 of the Education Code is amended to read: 8222.5. (a) Alternative payment programs may provide payment to child care facilities with at least 75 percent subsidized children in any of the following circumstances: (1) There is a lack of licensed child care facilities in the area. (2) The facility is able to meet the special needs of a particular child. (3) Any other reason provided for by the department's regulations. (b) It is the intent of the Legislature that the Superintendent of Public Instruction adopt regulations to implement a process whereby a child care facility may apply to the State Department of Education for funding pursuant to subdivision (a).
