SUMMARY
This bill would define a "public agency" for purposes of the
Meyers-Milias-Brown Act to include auxiliary organizations of
the California State University, and a "public employee" as
persons employed by auxiliary organizations. In addition, the
bill:
Specifies that public employees do not include persons employed
(a) by a student body organization, (b) for fundraising, grants
and contract administration, or commercial services, (c) on a
casual basis, as specified, and (d) a confidential employee,
managerial employee, or supervisory employee.
FISCAL EFFECT
Minor absorbable costs to the Public Employees Relations Board.
COMMENTS
1)Rationale . According to the sponsors, the California State
Employees Association, work being done by employees of
auxiliary organizations, notably CSU foundations, is being
performed under the auspices of CSU and is to the benefit of
CSU and its students. In effect, the work is distinguishable
from the work of other CSU employees only by the source of
funding and the employee's inability to enjoy the rights and
protections of collective bargaining under HEERA.
2)Meyers-Milias-Brown Act . Provides for collective bargaining
between local public agencies and public employee
organizations.

3)Prior legislation , AB 1535 (Wildman, 2000), which passed this
committee, was eventually amended into a study bill and was
vetoed.
