CONCURRENCE IN SENATE AMENDMENTS

SUMMARY : Defines a Family Child Care Home Education Network
(FCCHEN) and requires that these entities support educational
objectives for children in home-based child care programs that
serve families eligible for subsidized child care.
The Senate amendments:
1)Further define FCCHEN as an entity organized under law that
contracts with the State Department of Education (SDE) to make
payments to licensed family child care home providers and to
provide educational and support services to those providers and
to children and families eligible for state-subsidized child care
and development services.
2)Remove the specific requirement that a FCCHEN use the SDE's
desired results system of outcome measures.
3)Delete the requirement that each family child care home education
network contractor establish a written policy that describes the
relationship, including the establishment of rates and conditions
determining whether the provider is an independent contractor or
an employee of FCCHEN, between FCCHEN and each provider
affiliated with FCCHEN.
4)Specify that SDE is not required to modify its contacting
procedure that was in effect for a FCCHEN prior to January 1,
2005.
5)Add language to prevent a conflict with SB 1657 (Scott) and make
other technical changes.
AS PASSED BY THE ASEMBLY, this bill:
1)Defined a FCCHEN as a local education or governmental agency or
non-profit that contracts with SDE to make payments to family
child care home providers and provides education support services

to parents and providers that serve state-subsidized families.
2)Required each FCCHEN to implement the SDE desired results system
of outcome measures after SDE modifies its existing set of
measures designed for center-based childcare providers.
FISCAL EFFECT : The Assembly Appropriations Committee analysis
determined that there is no cost, this bill simply codifies current
practice.
COMMENTS : Since 1972, SDE has contracted with FCCHENs "to meet the
increasing complexity of provisions of child development programs
during a time when facilities were in extremely short supply ?"
FCCHENs advertise for, recruit, enroll and certify families in
state-funded child care. This model is not unlike the Foster
Family Agency model used in foster care settings.
