AB 1731 (Housing and Community Development Committee) - As
Introduced: March 5, 2003
SUBJECT : Statewide Housing Plan.
SUMMARY : Requires the Department of Housing and Community
Development (HCD) to prepare the Statewide Housing Plan (SHP)
every five years instead of every two years. Specifically, this
bill :
1)Removes requirements that HCD include in the SHP a comparison
of the housing goals for the preceding two years with the
amount of building permits issued and mobilehomes sold during
those two years.
2)Removes obsolete statutory requirement that the SHP provide a
data base but instead provide a reference guide for local
housing market studies and housing elements.
EXISTING LAW requires HCD to prepare the SHP biennially and to
include a revision of the overall housing needs and goals of the
state for future years, discussion of the housing needs of
specific populations and recommendations for federal, state,
local or private action to meet these goals.

COMMENTS :
Background
The bill is sponsored by HCD in an attempt to bring obsolete
statutes up to date with the real world practicability of the
SHP. In reality, HCD has never met the requirement to publish
the plan every two years primarily due to fiscal constraints or
other activities assigned priority by the Legislature or the
Administration.
Also, HCD is proposing to eliminate what it feels are obsolete
provisions of statute that either make references to data no
longer available or include references to the existing two year

timeframe for the Plan. In their background HCD states that,
"The availability and dominance of federal housing assistance,
and state administration of housing assistance resources, have
changed significantly since the inception of the SHP . . . The
delivery system is much more fragmented than when the SHP
provisions were initially enacted."
