STAFF COMMENTS: This bill may meet the criteria for
referral to the Suspense file.
AB 2348 would make the following changes to housing element
law:
1.Modify what is to be included in a local government's
land inventory, as specified, to ensure local governments
provide sufficient detail and uniform information
regarding the adequacy of sites to address the regional
housing need;
2.Expand the relocation assistance that local governments
must make available to persons displaced by the
rehabilitation of sites;
3.Require the Department of Housing and Community
Development (HCD) to evaluate a proposed or adopted
housing element for substantial compliance with housing
density law and would revise the requirements that may be
imposed on a development project that contributes to
meeting the regional housing need;
4.Revise parking requirements for developments qualifying
for density bonuses; and
5.A number of technical and non-substantive amendments.
HCD has indicated that AB 2348 would not result in any
costs to implement.
AB 2348 expands the requirements on local governments
pertaining to the implementation of housing element law and
results in an unknown reimbursable mandate. STAFF NOTES
that there are over $2 billion in unpaid mandate claims at
the Controller's Office; it is estimated that an additional
$600 million in claims will be submitted in 2004-05.
STAFF NOTES that AB 2348 provides that it will not become
operative unless AB 2158 (Lowenthal) is also enacted. (AB
2158 is also before the committee today.)
