An act to amend Section 68750 of the Government Code, relating to
the Commission on Judicial Performance.

AB 2729, as introduced, Leno. Commission on Judicial Performance.
Existing law specifies the authority of the Commission on Judicial
Performance to conduct investigations and formal proceedings,
including, the power to administer oaths, order the inspection of
books and records, and compel the attendance of witnesses and the
production of testimony.
This bill would additionally authorize the commission to take
testimony.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 68750 of the Government Code is amended to
read:
68750. (a) In the conduct of investigations and formal
proceedings, the commission or the masters may (a)
administer do any of the following:
(1) Administer oaths ; (b) order .
(2) Take testimony.
(3) Order and otherwise provide for the inspection of books
and records ; and (c) issue .
(4) Issue subpoenas for the attendance of witnesses and the
production of papers, books, accounts, documents and testimony
relevant to any such investigation or formal proceeding.
(b) The power to administer oaths, to issue subpoenas,
or to make orders for or concerning the inspection of books and
records may be exercised by a member of the commission or a master,
unless the commission shall otherwise determine.
