   An act to amend Sections 8718 and 8823 of the Family Code,
relating to adoption.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 447, as introduced, La Suer.   Adoption: final hearings.
   Existing law requires prospective adoptive parents and the child
proposed to be adopted to appear before the court, as specified.
   This bill would authorize the court to waive the requirement that
prospective adoptive parents and the child proposed to be adopted
appear before the court at the final hearing in which the court makes
and enters the order of adoption of the child.
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.  Section 8718 of the  Family Code  is amended to read:
   8718.  The prospective adoptive parents and the child proposed to
be adopted shall appear before the court pursuant to Sections 8612
and 8613.  However, the court may waive the requirement that the
prospective adoptive parents and the child proposed to be adopted
appear before the court at the final hearing in which the court makes
and enters the order of adoption of the child. 
  SEC. 2.  Section 8823 of the  Family Code  is amended to read:
   8823.  The prospective adoptive parents and the child proposed to
be adopted shall appear before the court pursuant to Sections 8612
and 8613.  However, the court may waive the requirement that the
prospective adoptive parents and the child proposed to be adopted
appear before the court at the final hearing in which the court makes
and enters the order of adoption of the child.
