   Existing law requires the Superintendent of Public Instruction to
establish the content, process, and frequency for conducting reviews
of school district achievement related to categorical programs. 

   This bill would require the Superintendent of Public Instruction
to take specified action regarding the review of categorical
programs.  
   The existing Child Nutrition Act of 1974, among other things,
requires the State Department of Education to develop and maintain
nutrition guidelines for school lunches and breakfasts, and all food
and beverages sold at school sites, as specified.  
   This bill would state the intent of the Legislature that school
districts provide professional development training to food service
workers in the public school system, as specified.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


   SECTION 1.    The Superintendent of Public
Instruction shall accomplish all of the following:  
   (a) Improve and refine the coordinated compliance review of
categorical programs described in Part 36 (commencing with Section
64000) of the Education Code by using data-driven and results-based
monitoring. This monitoring process should give priority to statutory
requirements essential to the effectiveness of categorical programs
in enhancing pupil achievement.  
   (b) Involve stakeholder groups in the development and
implementation of this monitoring process.  
   (c) Conduct a pilot program utilizing the monitoring process
described in Part 36 (commencing with Section 64000) of the Education
Code for federal categorical programs to the extent permitted by
federal law.  
   (d) Evaluate this monitoring process subsequent to its
implementation and report to the Legislature upon its request. 

  SECTION 1.    Section 49537 is added to the
Education Code, to read:
   49537.  It is the intent of the Legislature that school districts
provide professional development training to food service workers in
the public school system, including, but not limited to, food service
managers and directors, to address the epidemic of childhood
obesity. It is the intent of the Legislature that this training
include, but not be limited to, menu planning, recipe development,
and food safety.
