BILL SUMMARY:
AB 2695 extends the sunset, from 2007 to 2010, on the $400
minimum mandatory fine an individual granted probation for a
domestic violence crime may have imposed, the allocation of
these payments between local and state domestic violence special
funds. AB 2695 also eliminates the 2007 sunset date on the
waiving of fees associated with service of process for specified
restraining orders and injunctions.

STAFF COMMENTS:
AB 352 (Goldberg, 2003) increased the mandatory minimum fine
imposed on persons granted probation for a domestic violence
crime from $200 to $400 until 2007. AB 352 also changed the
allocation formula for these fine monies, from one-third going
to local domestic violence special funds and two-thirds to state
domestic violence special funds to two-thirds local and
one-third state. AB 2695 would extend the sunset on these
changes to 2010. Additionally, AB 2695 would eliminate the 2007
sunset date for the waiver of fees associated with the service
of process for protective orders, restraining orders and
injunctions.
The state portion of domestic violence fines are deposited into
two funds - the Domestic Violence Restitution Order
Reimbursement Fund, administered by the Department of Justice,
and the Domestic Violence Training and Education Fund,
administered by the Department of Health Services. Transfers
into the funds from local agencies have remained relatively
steady since AB 352's enactment in 2004. Both departments
indicated they projected no fiscal impact to AB 2695.
