BILL SUMMARY: SB 753 would revise the parent notification
process relating to a school district's authority to excuse a
student from school to obtain confidential medical services
without parental consent. The bill revises the notification
process in a manner that would result in the expansion of an
existing state mandated local program.

STAFF COMMENTS: This bill meets the criteria to be referred to
the Suspense File.
In 1983, the Attorney General issued an opinion clarifying that
public schools may release students from campus for confidential
health care without notifying students' parents (66 Ops. Cal
Atty. Gen. 244).
Education Code 46010.1 provides that the notice required
pursuant to this section may be included with any other notice
given pursuant to this code. This bill would modify that
section to provide that the notice may be included with any
other notice given pursuant to the Education Code if the notice
is printed on a piece of paper separate from any other notice or
requirement. The notice would be required to meet size and
print requirements, as well.
The 2001-02 Budget appropriated $2,020,537 for Chapter 448/75,
which established the annual parent notification process. A ten
percent increase in the cost of this mandate would increase
reimbursement costs by more than $200,000 annually.
Alternatively, in 2003-04 there were 2,800,000 students in
grades 7 to 12. If the cost of adding a notice on a piece of
paper separate from any other notice or requirement is $0.10 per
notice, the cost of this mandate would increase reimbursement
costs by $280,000 annually.
In 2003-04, the annual parent notification mandate (III)
resulted in costs of approximately $5,400,000. Total
outstanding liability for this mandate as of 11/2004 is more
than $16,500,000.
