SUBJECT : Inmates: health care services

DIGEST : This is a new bill. As this bill left the
Senate, it dealt with private child support collection
agencies. As amended, this bill now is a technical cleanup
measure to SB 159 of this year.
Assembly Amendments (1) allowed other public agencies,
other than specified law enforcement agencies, to contract
for emergency health services, as specified, and (2) added
an urgency clause.
ANALYSIS : Existing law authorizes the Department of
Corrections and Rehabilitation, county sheriffs, and police
chiefs to contract with providers of emergency health care
services.
This bill, in addition, allows other public agencies that

contract for emergency health services to contract with
providers for emergency health care services for care to
local law enforcement patients.
Existing law provides that specified associations convene a
working group to address fiscal issues relating to the
provision of this contracted emergency medical health
services.
This bill provides that to the extent that these contracts
result in a disproportionate share of local law enforcement
inmates being treated at any one hospital or system of
hospitals, this working group shall address this issue.
Prior legislation . SB 159 (Runner), Chapter 481, Statutes
of 2005, passed the Senate with a vote of 32-0 on 9/8/05.

ARGUMENTS IN SUPPORT : The University of California
states, "As public institutions, the UC academic medical
centers are in a unique position with respect to the
provision of health care services to local law enforcement
patients. Existing contracts between UC medical centers
and local law enforcement are contained within larger city
or county contracts -- these contracts find UC partnering
with local government to meet key public health goals.
Central to these contracts is ensuring healthcare access to
medically indigent patients. As amended on May 18th, SB
896 clarifies that the contracts are for emergency health
care services for local law enforcement patients and can be
entered into with other public agencies that contract for
these types of services. SB 896 also provides similar
clarification to the "grandfather" clause contained in last
year's legislation. The University supports SB 896 because
it provides needed technical clean-up to last year's SB
159."
