SUBJECT : Inmates: health care services

DIGEST : This is a new bill. As this bill left the
Senate, it dealt with private child support collection
agencies. As amended, this bill now is a technical cleanup
measure to SB 159 of this year.
Assembly Amendments (1) allowed other public agencies,
other than specified law enforcement agencies, to contract
for emergency health services, as specified, and (2) added
an urgency clause.
ANALYSIS : Existing law authorizes the Department of
Corrections and Rehabilitation, county sheriffs, and police

chiefs to contract with providers of emergency health care
services.
This bill, in addition, allows other public agencies that
contract for emergency health services to contract with
providers for emergency health care services for care to
local law enforcement patients.
Existing law provides that specified associations convene a
working group to address fiscal issues relating to the
provision of this contracted emergency medical health
services.
This bill provides that "other public agencies," as well as
local sheriffs and police chiefs, are authorized to
contract with hospitals for emergency health care for
"local law enforcement patients."
This bill provides that, to the extent that the rate
provisions of Section 4011.10 of the Penal Code results in
a disproportionate share of local law enforcement patients
being treated at any one hospital or system of hospitals,
the Inmate Health Care and Medical Provider Fair Pricing
Working Group shall address this issue.
Prior legislation . SB 159 (Runner), Chapter 481, Statutes
of 2005, passed the Senate with a vote of 32-0 on 9/8/05.

ARGUMENTS IN SUPPORT : According to the author, "This
bill is a technical, clean-up measure to SB 159 (Runner),
Chapter 481, Statutes of 2005, that dealt with emergency
health care for local law enforcement patients. This bill
will clarify that public agencies, such as county public
health departments, can enter into contracts with hospitals
for emergency health care."
