An act to add Sections 1520.7 and 1569.194 to the Health and
Safety Code, relating to community care facilities.
LEGISLATIVE COUNSEL'S DIGEST
AB 304, Huff. Community care facilities and residential care
facilities for the elderly: disaster and mass casualty plans.
Existing law, the California Community Care Facilities Act,
provides for the licensure and regulation of community care
facilities, as defined, and provides for criminal sanctions for a
violation of those provisions. Existing law requires any person
desiring issuance of a license for a community care facility or a
special permit for specialized services to file with the State
Department of Social Services, an application on a prescribed form,
containing specified information.
Existing law, the California Residential Care Facilities for the
Elderly Act, provides for the licensure and regulation of residential
care facilities for the elderly, as defined, and provides for
criminal sanctions for a violation of those provisions. Existing law
requires any person desiring issuance of a license or a special
permit for a residential care facility for the elderly to file with
the department, an application on a prescribed form, containing
specified information.
This bill would require a community care facility or residential
care facility that is licensed or has a special permit therefor to
provide a copy of the disaster and mass casualty plan required
pursuant to specified regulations to any fire department, law
enforcement agency, or civil defense or other disaster authority in
the area or community in which the facility is located, upon request
of the fire department, law enforcement agency, or civil defense or
other disaster authority.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 1520.7 is added to the Health and Safety Code,
to read:
1520.7. (a) Every community care facility that is licensed or has
a special permit for specialized services pursuant to Section 1525
shall provide a copy of the disaster and mass casualty plan required
pursuant to Section 80023 of Title 22 of the California Code of
Regulations to any fire department, law enforcement agency, or civil
defense or other disaster authority in the area or community in which
the facility is located, upon request by the fire department, law
enforcement agency, or civil defense or other disaster authority.
Section 1540 shall not apply to this section.
(b) The department is not required to monitor compliance with this
section as part of its regulatory monitoring functions.
SEC. 2. Section 1569.194 is added to the Health and Safety Code,
to read:
1569.194. (a) Every residential care facility for the elderly
that is licensed or has a valid special permit therefor pursuant to
Section 1569.10 shall provide a copy of the disaster and mass
casualty plan required pursuant to Section 87223 of Title 22 of the
California Code of Regulations to any fire department, law
enforcement agency, or civil defense or other disaster authority in
the area or community in which the facility is located, upon request
by the fire department, law enforcement agency, or civil defense or
other disaster authority. Section 1569.40 shall not apply to this
section.
(b) The department is not required to monitor compliance with this
section as part of its regulatory monitoring functions.
