SUBJECT : Budget Act of 2008: Mental Health Services

DIGEST : Senate Floor Amendments of 2/14/09 delete the
prior version of the bill expressing the intent of the
Legislature to make statutory changes relating to the
Budget Act of 2008.
This bill now amends the Mental Health Services Act, an
initiative measure enacted by the voters as Proposition 63
in 2004 and which requires a vote of the people. The bill
is necessary in order to obtain a total of $460.7 million
in Mental Health Services Act Funds to backfill for state
General Fund support over a two-year period.
ANALYSIS : If enacted by the voters, this bill permits
$226.7 million (Mental Health Services Act Funds) in
2009-10, and up to $234 million (Mental Health Services Act
Funds) in 2010-11 to be used to backfill for General Fund
support to assist in funding the Early and Periodic

Screening, Diagnosis and Treatment Program as administered
by the Department of Mental Health. Therefore, over the
two-year period, a total of $460.7 million will be used to
offset state General Fund support in this program.
