           DIGEST  :    This resolution authorizes the California Law  
          Revision Commission (CLRC) to study whether specified laws  
          should be revised, authorizes the CLRC to study the legal  
          and policy implications of treating a charter school as a  
          public entity for the purposes of the Tort Claims Act, and  
          authorize removal of one topic from the calendar of the  
          CLRC.

           Senate Floor Amendments  of 8/24/09 make technical  
          corrections and remove language prohibiting the CLRC from  
          making specified recommendations.

           ANALYSIS  :    Existing law authorizes the CLRC to study  
          topics approved by concurrent resolution of the

          Legislature.  (Section 8293 of the Government Code)

          This resolution reauthorizes the CLRC's study of specified  
          topics.

          This resolution authorizes the CLRC to study the legal and  
          policy implications of treating a charter school as a  
          public entity for the purposes of the Tort Claims Act.

          This resolution removes the CLRC's authority to study the  
          law relating to offers of compromise.

          This resolution requires that before commencing work on any  
          project within the calendar of topics authorized or  
          directed for study by the Legislature, the CLRC shall  
          submit a detailed description of the scope of work to the  
          chairs and vice chairs of the Senate and Assembly Judiciary  
          Committees, and if during the course of the project there  
          is a major change to the scope of work, submit a  
          description of the change.

           ARGUMENTS IN SUPPORT  :    According to the sponsor, the  
          CLRC, this resolution is the annual concurrent resolution  
          authorizing the CLRC's study of selected topics.  "ACR 49  
          would continue the CLRC's existing study authority of 21  
          specific topics, and delete the authorization of one topic  
          which has now been substantially addressed by case law.   
          ACR 49 would also add authorization to study the legal and  
          policy implications of treating a charter school as a  
          public entity for the purposes of the Tort Claims Act."
