SUMMARY
This bill:
1)Authorizes the Santa Clara Valley Transportation Authority
(VTA) to provide funding for the repair and maintenance of
those facilities for which it already has authority to acquire
and construct.
2)Authorizes the VTA, subject to approval of Caltrans, to
provide funding for the repair and maintenance of state
highways within the VTA's boundaries.
FISCAL EFFECT
Negligible fiscal impact.
COMMENTS
1)Background . The VTA is both the transit agency and the
congestion management agency in Santa Clara County. In
discharging its responsibilities as a congestion management
agency, VTA collaborates with cities, the county, and
Caltrans to plan improvements to the roadway network serving
the county. Existing law authorizes VTA to allocate revenues
from its local transportation sales tax program, the federal
Congestion Mitigation and Air Quality Program (CMAQ), and the
federal Surface Transportation Program (STP) for the
construction and maintenance of transit projects, however, it
is unable to allocate funds for the repair and maintenance of
street and road projects and state highways.

2)Purpose . This bill authorizes VTA to allocate revenues from
various sources for repair and maintenance of all its
transportation facilities, including streets, roads, and
pedestrian facilities. This bill also grants VTA the
authority to fund the maintenance and repair of state
highways, but explicitly provides that VTA may not actually do
the repair and maintenance.
3)Prior Legislation . This bill is nearly identical to AB 152
(Beall) of 2008, which was summarily vetoed by the governor
without a stated objection. AB 152 passed the Assembly floor
75-0.
