DIGEST : Senate Floor Amendments of 2/17/10 delete the
prior version which contained clean-up provisions in the
area of Proposition 1A of 2004 borrowing and securitization
in order to amend the 2009 Budget Act. This bill now
contains provisions which provide the necessary statutory
changes in the area of emergency response in order to enact
modifications to the 2009 Budget Act.
ANALYSIS : This is the emergency response trailer bill
which makes changes to the 2009-10 Final Budget Act as
follows:
1. Emergency Response Fund . This bill establishes a 4.8
percent surcharge on all new or renewed commercial and
residential fire and multiperil property insurance
policies issued or renewed on or after July 1, 2010.
Revenues created by this surcharge will be deposited
into the newly established Emergency Response Fund for
use for emergency activities of the California Emergency

Management Agency, the Department of Forestry and Fire
Protection, and the Military Department.
2. Emergency Response Grants . This bill establishes the
Local Government Mutual Aid Enhancement Program to
provide local agencies additional funding to enhance or
sustain fire and rescue disaster mutual aid capacity to
combat the effects of emergencies and disasters. Local
agencies will receive 31.3 percent of revenues deposited
into the Emergency Response Fund beginning July 1, 2011.
