SUMMARY
This bill allows the Attorney General (AG) to furnish criminal
history information to a foreign government when requested for
child adoption purposes.
FISCAL EFFECT
There are no costs associated with this legislation.
COMMENTS
Rationale . The Department of Justice (DOJ) is the statutorily
mandated repository for criminal history records and is
responsible for providing state summary criminal history
information to various specified entities for specified
purposes. According to the author, DOJ does not have the
explicit statutory authority to search for or release this
information to individuals or foreign governments to aid the
determination of a current or previous California resident's
suitability to adopt a child from a foreign country. This
legislation, sponsored by the Attorney General's Office, would
provide that explicit authority.
