SUMMARY
This bill requires the Department of Housing and Community
Development (HCD) to develop standards for ventilation systems
for new multifamily residential buildings (10 or more units)
located within 500 feet of a roadway for areas exceeding a
specified particulate matter (PM) level. The bill also specifies
that:
1)HCD consult with the Air Resources Board and the California
Energy Commission when adopting these standards.
2)HCD propose these standards to the California Building
Standards Commission (CBC) by July 1, 2012.
FISCAL EFFECT
1)HCD indicates that would require two positions, at an annual
cost of $200,000 per year (GF), for two years to develop the
standards.
2)Minor costs to the building standards commission to adopt the
standards.
COMMENTS
1)Purpose . This bill is intended to address relatively high
pollution exposure faced by individuals living near freeways.
The author asserts that public health research has
consistently demonstrated that children living within 200
meters of freeways or busy roadways have poorer lung function
and more asthma and respiratory systems than those living

further from freeways. The bill is similar to a local
ordinance, sponsored by the author, which was adopted by the
City of San Francisco last year.
2)Background . Existing law requires all building standards that
are adopted or proposed by state agencies to be submitted,
approved and adopted by the Building Standards Commission
(BSC). HCD is required to propose adopting, amending or
repealing building standards to BSC for residential buildings.
In 2008, the California Energy Commission (CEC) adopted new
energy efficiency standards (Title 24), which go into effect
this summer. The standards require mechanical ventilation to
alleviate indoor air emissions associated with new
construction.
