DIGEST : This bill authorizes the Department of Food and
Agriculture to spend funds collected in the Citrus Disease
Management Account immediately, through June 30, 2010 to
help prevent citrus pests and diseases affecting citrus
grown in California.
Senate Floor Amendments of 3/24/10 (1) delete the prior
version relating to the San Joaquin Valley Quality Cotton
District, and instead, add the current provisions which
authorize the Department of Food and Agriculture to expend
funds in the Citrus Disease Management Account Immediately,
through June 30, 2010, for the purpose of preventing citrus
pests and diseases affecting California citrus, (2) include
Assemblymember De Leon as principal author, and (3) add an

urgency clause.
ANALYSIS : Existing law creates in the Department of Food
and Agriculture (DFA) the California Citrus Pest and
Disease Prevention Committee, composed as specified, with
specified powers and duties, including, among others, the
authority to develop, subject to the approval of the
Secretary of DFA, a statewide citrus specific pest and
disease work plan that includes informational programs to
educate and train residential owners of citrus fruit, local
communities, groups, and individuals on the prevention of
pests, and diseases and their vectors, specific to citrus
and programs for surveying, detecting, analyzing, and
treating citrus pests and diseases. Existing law
authorizes the imposition of a monthly assessment on citrus
producers, as provided, for specified related purposes, and
requires the assessment to be remitted to the department
and deposited into the Citrus Disease Management Account in
the Department of Food and Agriculture Fund, which funds in
that account are available upon appropriation by the
Legislature.
This bill authorizes the DFA to spend funds collected in
the Citrus Disease Management Account immediately, through
June 30, 2010.
Comments
AB 281 (De Leon), Chapter 426, Statutes of 2009, created
the California Citrus Pest and Disease Prevention
Committee, and authorized a monthly assessment on citrus
producers which would be deposited in the Citrus Disease
Management Account to help prevent citrus pests and
diseases. While the bill authorized the collection of the
funds, AB 281 did not authorize the expenditure of the
funds until the following fiscal year. This bill
authorizes the expenditure of the funds in the Citrus
Disease Management Account immediately, through June 30,
2010.
