SUMMARY
This bill requires the Department of Social Services (DSS) to
negotiate in good faith with an Indian tribe, organization, or
consortium that requests the development of an agreement with
the state to administer all or part of their own federal IV-E
programs on behalf of Indian children who are under the
authority of the tribe, organization, or consortium.
FISCAL EFFECT
Workload associated with DSS amending their state plan to comply
with federal law are minimal and absorbable within existing
resources.
COMMENTS
Rationale . This bill is intended to direct DSS to adopt policies
that conform to federal laws regarding foster care for Indian
children. Specifically, DSS will need to amend their foster care
state plan to include a commitment that the state will negotiate
in good faith with an Indian tribe, tribal organization, or
consortium that wants to administer all or part of their own
foster care program.
