SUMMARY : Permits the incidental take of rock crab with
Dungeness crab traps, and vice versa, and repeals the
prohibition on possession of both species aboard the same vessel
at the same time.
The Senate amendments require the Department of Fish and Game
(DFG) to report to appropriate policy and fiscal committees of
the Legislature the impacts of this bill, if any, on or before
January 1, 2013, including the number of citations issued
relating to both rock crab and Dungeness crab for the years 2010
to 2012 inclusive.
EXISTING LAW :
1)Requires any rock crab taken with a Dungeness crab trap, and
any Dungeness crab taken with a rock crab trap, to be
immediately returned to the waters from which it was taken.
2)Prohibits any person from possessing a rock crab aboard a
vessel when the vessel is being used to take Dungeness crab,
and from possessing a Dungeness crab aboard a vessel when the
vessel is being used to take rock crab.
3)Establishes other restrictions related to minimum size, sex,
season, trap size, and permit requirements. Rock crab can be
taken at any time, whereas Dungeness crab is subject to
seasonal restrictions.
AS PASSED BY THE ASSEMBLY , this bill authorized Dungeness crab
to be taken incidentally with a rock crab trap, and rock crab to
be taken incidentally with a Dungeness crab trap, during the
season when it is lawful to take both species. This bill also
repealed the prohibition on possession of both species onboard a

vessel simultaneously.
FISCAL EFFECT : According to the Senate Appropriations Committee
analysis, estimated costs of $50,000 in 2009/10 and $100,000 in
2010/11 and 2011/12 to the Fish and Game Preservation Fund.
COMMENTS : This bill as passed by the Senate is substantially
the same as passed by the Assembly, with the addition of a
reporting requirement.
