           SUMMARY  :  Increases from 24 to 48 the number of oral and  
          suppository drugs permitted to be stored in secured emergency  
          drug supply kits provided by a pharmacy to a skilled nursing  
          facility (SNF) or an intermediate care facility (ICF).  Allows  
          up to four of the 48 of the emergency drug supply kits to be  
          psychotherapeutic drugs, with additional flexibility to allow up  
          to 10 psychotherapeutic drugs, at the discretion of the  
          Department of Public Health (DPH).  Increases the allowable  
          limit on the number of doses of each drug in an in an emergency  
          drug supply kit from four to not more than 16 separate doses.

           The Senate amendments  :

          1)Increase the allowable limit on the number of doses of each  
            drug in an emergency drug supply kit from four to not more  
            than 16 doses.

          2)Cap the number of psychotherapeutic drugs in an emergency drug  
            supply kit at 4 of the 48.

          3)Allow DPH to grant a program flexibility request to a facility  
            to store up to 10 separate psychotherapeutic drugs in an  
            emergency drug supply kit, if the facility can demonstrate a  
            necessity.

          4)Exempt special treatment program service unit distinct part  
            SNF from the four psychotherapeutic drug limit.

          5)Require DPH to limit the number of doses of each  
            psychotherapeutic drug in each emergency drug supply kit to

           EXISTING LAW  :

          1)Requires DPH to license and inspect health facilities,  
            including SNFs.

          2)Authorizes a pharmacy to furnish a dangerous drug or device to  
            a licensed health care facility, including a SNF and ICF for  
            storage in a secure emergency pharmaceutical supply container  
            maintained in the facility under specified conditions.

          3)Limits the number of oral and suppository drugs provided to a  
            health facility for storage in a secured emergency container  
            to 24 different drugs; and, authorizes DPH to limit the number  
            of doses of each drug to four.

          4)Defines "special treatment program service unit distinct part"  
            as an identifiable and physically separate unit of a SNF or an  
            entire SNF that provides therapeutic programs to an identified  
            mentally disordered population.
           AS PASSED BY THE ASSEMBLY  , this bill increased from 24 to 48 the  
          number of oral and suppository drugs permitted to be stored in  
          emergency drug supply kits at long-term care facilities.
