DIGEST : This bill authorizes a community college
district to charge a facilities fee to any nonresident
student, in addition to the nonresident tuition fee.
Currently, a facilities fee may only be charged to students
who are both citizens and residents of a foreign country.
The fee amount shall not exceed the amount that was
expended by the district for capital purposes in the
preceding fiscal year divided by the total full-time
equivalent students of the district in the preceding fiscal
year. The facilities fees may only be used to fund capital
outlay, maintenance and equipment.

ANALYSIS :
Existing Law
1.Allows a California Community College (CCC) district to
charge a nonresident tuition fee to nonresident students,
with certain exceptions, and requires the fee to be set
according to a formula that divides the expense of
education in the CCC district by the number of full-time
equivalent students attending the CCC district in a
preceding year.
2.Allows CCC districts to charge a capital outlay fee in
addition to the nonresident tuition fee to nonresident
students who are both citizens and residents of a foreign
country as specified.
Who Currently Charges the Fee ? According to the CCC
Chancellor's office, 35 of 108 CCC districts currently
charge a capital outlay fee to foreign nonresident
students. The fee ranges from a low of $5 per unit to a
high of $50 per unit. The average fee is $8 per unit. In
addition to this fee, the statewide average for nonresident
students is $190 per unit (from a low of $115 per unit to a
high of $239) whereas resident students pay $20 per unit.

ARGUMENTS IN SUPPORT : According to the author's office,
this bill addresses an inequity in current law. Resident
students theoretically support capital improvements through
their taxes, and current law allows CCC districts to charge
foreign students nonresident fees for capital outlay;
however, nonresident students who are U.S. citizens do not
pay capital outlay fees, even though they use the
facilities in the same way as resident and foreign
