          CONCURRENCE IN SENATE AMENDMENTS

           SUMMARY  :  Establishes a position of director within the  
          California Department of Justice (DOJ) responsible for  
          coordinating California's response to missing persons.  

           The Senate amendments  delete the Assembly version of this bill,  
          and instead:

          1)Require the DOJ to establish a director position responsible  
            for coordinating California's response to missing persons.   
            Specifically, this position is required to:

             a)   Assist law enforcement agencies, at their request, with  
               the timely search and recovery of at-risk abducted  
               children; 

             b)   Maintain up-to-date knowledge and expertise of those  
               protocols, best practices, and technologies that are most  
               effective for recovering missing children in a timely  
               manner;

             c)   Maintain relationships with federal, state, and local  
               law enforcement agencies and other entities responsible for  
               the investigation of missing persons in the state;

             d)   Maintain records and make the Commission on Peace  
               Officer Standard and Training Guidelines for Handling  
               Missing Persons Investigations document available to law  
               enforcement agencies upon their request.  

          2)Require the Director to use existing resources within the  
            Attorney General's Office to the extent possible to accomplish  
            the stated purposes.

          EXISTING LAW
           
          1)Requires the Attorney General (AG) to establish and maintain  
            the Violent Crime Information Center to assist in the  
            identification and the apprehension of persons responsible for  
            specific violent crimes and the disappearance and exploitation  
            of persons.  

          2)Requires the AG to establish and maintain an online automated  
            computer system designed to effect an immediate law  
            enforcement response to reports of missing persons.  This  
            information is available to law enforcement agencies unless  
            the reporting agency requests the information not be released  
            because it would impair a criminal investigation.  

          3)Requires the AG to establish the Missing and Exploited  
            Children's Recovery Network.  This network consists of a  
            computer system which electronically transmits a missing child  
            poster, containing the name, personal description and picture  
            of the mission child to all state and local law enforcement  
            agencies.  The AG shall work in cooperation with the National  
            Center for Mission and Exploited Children to develop and  
            implement a network that can electronically interface with the  
            National Network.  

          4)Requires the California Highway Patrol to activate the  
            Emergency Alert System where a child under the age of 18, or a  
            person who has a proven physical or mental disability, has  
            been abducted and is in imminent danger of serious bodily  
            injury or death.  

           AS PASSED BY THE ASSEMBLY  , this bill authorized the Ventura  
          Unified School District to deposit $10 million of the proceeds  
          from the sale of surplus real property, together with any  
          personal property located on that property, purchased entirely  
          with local funds and sold before January 1, 2005, into the  
          general fund of the school district and use the proceeds from  
          the sale for any one-time general fund purpose.

           FISCAL EFFECT  :  According to the Senate Appropriations  
          Committee, the new DOJ position is up to $112,000 for 2010-11,  
          up to $208,000 for 2011-12, and up to $208,000 for 2012-13.

           COMMENTS  :  This bill was substantially amended in the Senate and

          the Assembly-approved provisions of this bill were deleted.   
          This bill, as amended in the Senate is inconsistent with  
          Assembly actions.
