To the Members of the California State Assembly:

I am returning Assembly Bill 1087 without my signature.

Measures that increase the sales and use tax revenues collected by
the state must be approved by two-thirds of the Legislature as
required by Proposition 13.  While I understand the author's intent
to simplify the calculation of sales and use taxes, this bill would
directly increase the amount of sales tax revenue collected from the
consumer.  Thus, this bill is a tax levy and requires a two-thirds
vote of the Legislature.

Since this bill was only approved by a majority vote, this bill
presents constitutional issues.  For this reason, I will not
reconsider this bill until it receives a two-thirds vote of the
Legislature.
