SUMMARY
This bill makes additional traffic laws enforceable on offstreet
private parking facilities upon enactment of an ordinance or
resolution by a city or county. The additional traffic laws that
would be enforceable in privately owned and maintained offstreet
parking facilities are:
1)Failure to obey a traffic control sign.
2)Throwing a substance at a vehicle.
3)Drinking an alcoholic beverage while driving.
4)Possession of an open container containing an alcoholic
beverage while driving.
5)Operating a vehicle with a sound system that can be heard from
50 or more feet.
6)Permitting a child under the age of six, or under 60 pounds,
to be transported in a vehicle without properly using a child
passenger restraint system.
FISCAL EFFECT
1)Potential, likely negligible, state trial court costs.
2)Unknown, likely minor, local revenue increase, to the extent
persons are cited and fined as a result of this bill.

COMMENTS
1)Rationale . The author's intent is to make several additional
existing traffic laws enforceable in private off-street
parking areas.
2)Current law provides that a city or county may declare there
are privately owned and maintained offstreet parking
facilities that may be used by the public. Upon enactment by
of a local ordinance, specified Vehicle Code Sections -
currently limited to speed laws - may apply to these
facilities.
