BILL SUMMARY: AB 1249 would extend from January 1, 2011 to
January 1, 2016 an authorization that the Department of Food and
Agriculture assess a fee on transporters of inedible kitchen
grease for the purposes of administering provisions regulating
these transporters. A violation of these provisions is a crime
and requires the funds collected to be deposited into the
continuously appropriated Food and Agriculture Fund. By
extending the operation of these provisions of law requiring
collection and deposit of funds into a continuously appropriated
fund, this bill would make an appropriation. In addition, this
bill would make inapplicable a prohibition on the transporting
of a dead animal to any place, other than to certain facilities
or destinations, when a wavier is granted by the State
Veterinarian during a state of emergency. This bill would
authorize the Secretary of Food and Agriculture to issue a
master or individual permit to a licensed renderer, collection
center or dead animal hauler for the purpose of authorizing
transport to a permitted landfill.

STAFF COMMENTS:
Food and Agriculture Code 19216 defines inedible kitchen grease
to mean any fat or used cooking greases and oils obtained from
any source.
Currently, a fee of $300 per year per vehicle that is operated
to transport kitchen grease, and not to exceed $3,000 per year
per registered transporter, is charged. (Any rendered who
operates vehicles to transport inedible kitchen grease shall
register as a transporter of inedible kitchen grease and pay a
registration fee of $100.) Persons who transport inedible
kitchen grease for his or her personal, noncommercial use are
exempt from 75 percent of the fees charged.
