DIGEST : This bill extends the current authority granted
to the Los Angeles Unified School District to fill
vacancies in specified job classifications from ranks other
than the top three ranks of an employment list, under
specified conditions.
ANALYSIS :
Existing law:
1. Authorizes, pursuant to AB 580 (Smyth), Chapter 528,
Statutes of 2007, and AB 415 (Karnette), Chapter 186,
Statutes of 2008, the Los Angeles Unified School

District to fill vacancies in specified job
classifications from ranks other than the top three
ranks of an employment list if specialized licenses,
certifications, knowledge, or ability that cannot
reasonably be acquired during the probationary period or
a specific gender is required. Current law applies this
authority to specified classifications of employees that
include administrative analyst, administrative
assistant, assistant contract administration analyst,
assistant realty agent, contracts administration
analyst, educational research analyst, financial
analyst, grants specialist, health care advocate, human
resources specialist III, insurance representative II,
insurance representative III, occupational health nurse,
parent community facilitator, senior internal auditor,
web developer, and any classifications that have been
designated as management.
2. Requires the Los Angeles Unified School District to
report to the affected labor unions, as specified, on
its use of this authority and sunsets the authority on
January 1, 2012.
This bill takes into account the following classifications:
accountant, assistant contracts supervisor, contract
assistant, coordinating contract assistant, principal
financial analyst, principal administrative analyst, senior
administrative analyst, senior administrative assistant,
and senior financial analyst.
Comments
According to the bill's sponsor, the Los Angeles Unified
School District Personnel Commission (LAUSDPC), "The
LAUSDPC oversees a classification system of approximately
1,150 separate classifications. Selective certification
helps to simplify the classification plan for the District
without adversely affecting the merit system. It allows
the Commission to spend less time developing eligibility
lists and focus on hiring people to fill needed jobs. This
is important because new classifications can initially take
over 250 hours of staff time from creation to development
of the first eligibility lists and maintenance of these
lists consumes an enormous amount of staff time. AB 1293,

effort to bring flexibility in hiring while protecting
existing employees' seniority and bumping rights."
