AB 1311 (Duvall) - As Amended: April 20, 2009
SUBJECT : State government reports.
SUMMARY : Revises and repeals specified state agency reports to
the Legislature. Specifically, this bill :
1)Repeals an annual DGS report to the Joint Legislative Budget
Committee (JLBC) and each Member of the Legislature to
summarize the following:
a) Leases by the state to others for residential or
commercial purposes in the Capitol area;
b) Sales or building construction initiated or completed by
the state in the metropolitan area expenditures, by type;
c) Transactions and operations of joint powers agencies
since the last report; and,
d) DGS's appraisal of the degree to which these projects
conform to the Capitol Area Plan.
2)Repeals provisions mandating the State Architect (SA) to
annually report to legislative fiscal committees on local
government building expenditures.
3)Repeals provisions mandating the Fair Employment and Housing
Commission (Commission) to include publications and research
results that will tend to promote good will and minimize or
eliminate unlawful discrimination.
4)Repeals annual reporting requirements mandating DGS to report
to legislative fiscal committees all leases entered into the
prior calendar year that include a purchase option involving
office space with another entity.
5)Repeals annual reporting requirements mandating DGS to report
to the Legislature how DGS is utilizing the authority to lease
any real property for up to 25 years.

6)Repeals annual reporting requirements mandating DGS to report
to the appropriate fiscal and policy committees of the
Legislature on prescription drug purchasing programs and
contracts that DGS jointly collaborates with the University of
California (UC) and the Public Employees' Retirement System
(CalPERS) on.
EXISTING LAW :
1)Requires DGS to annually report to the JLBC and each Member of
the Legislature and to list in detail the following:
a) Leases by the state to others for residential or
commercial purposes in the Capitol area;
b) Sales or building construction initiated or completed by
the state in the metropolitan area expenditures, by type;
c) Transactions and operations of joint powers agencies
since the last report; and,
d) DGS's appraisal of the degree to which these projects
conform to the Capitol Area Plan.
2)Requires the SA to annually report to legislative fiscal
committees on local government building expenditures.
3)Requires the Commission to include issuing publications and
research results that will tend to promote good will and
minimize or eliminate unlawful discrimination.
4)Requires DGS to report to legislative fiscal committees all
leases entered into the prior calendar year that include a
purchase option involving office space with another entity.
5)Requires DGS to report to the Legislature how DGS is utilizing
the authority to let any real property owned by the state not
exceeding five acres for a period not to exceed 25 years, to
governmental entities for emergency services.
6)Requires DGS to report to the appropriate fiscal and policy
committees of the Legislature on prescription drug purchasing
programs and contracts that DGS jointly collaborates with UC
and CalPERS on.

FISCAL EFFECT : Unknown
COMMENTS :
Purpose of the bill . According to the author's office, "The
intent of this bill is simply to delete outdated reporting
requirements, thereby saving money and spurring efficiency.
This will allow for less time and resources to be spent on
needless reports that are not relevant to Department
operations."
Background . Current law specifies the annual reporting
requirements that state entities must provide to the
Legislature.
Support . According to the sponsor, "After careful review and
consideration of the approximately 20 reports that the DGS is
specifically required to present to the Legislature, (the DGS
has) determined that four of these annual reports are no longer
necessary to our operations. The reasons we are proposing
elimination range from expired reporting requirements,
information readily available over the Internet, or reporting
requirements (that are) redundant.
The bill also has a provision to require a summary of a
particular report. Specifically, current law requires an annual
report that tracks the progress of State projects within the
vicinity of the State Capitol, called the Capitol Area Plan.
The report requires very detailed information on all specified
items. Typically, this extremely comprehensive report consists
of approximately 80 pages, which (the) DGS believe is
overwhelming for legislators and other recipients to read."
