SUBJECT : County Employees Retirement Law of 1937:
          alternative
                      survivor allowances

DIGEST : This bill appropriately cross-references an
alternative method of calculating survivors allowances in
the County Employees Retirement Law of 1937.

ANALYSIS : Existing County Employees Retirement Law of
          1937 ('37 Act):

          1.Authorizes a county operating a '37 Act retirement system
to provide optional survivor allowances to members who
receive retirement benefits from both the '37 Act
retirement system and federal social security on a
            nonintegrated basis.

          2

2.Provides that the survivor allowance is to be calculated
according to one of two alternative methods authorized by
            two separate sections of law.

This bill appropriately cross-references an alternative
method of calculating survivor's allowance in the '37 Act.

ARGUMENTS IN SUPPORT : According to the author's office,
"There are two options for payment of survivor benefits
when an employee had both a retirement benefit and Social
Security. However, both statutory options are not
references throughout the code. This bill includes the
references to the second option where references to t he
          first option appear."
