An act to amend Section 60422 of the Education Code,
relating to instructional materials. An act to amend
Sections 44260.2 and 44260.3 of, and to repeal Section 44260.8 of,
the Education Code, relat ing to adult education.

Adult education: teaching credentials.
(1) Existing law contains minimum specified requirements for the
designated subjects preliminary adult education teaching credential.
This bill would recast the adult credential for nonacademic and
academic subjects and specify different requirements for nonacademic
and academic subjects, as specified.
(2) Existing law contains minimum specified requirements for the 5
year renewal of the preliminary designated subjects adult education
teaching credential.
This bill would recast the minimum requirements for the 5 year
clear designated subjects adult education teaching credential, as
specified.
(3) Existing law provides specified minimum requirements for the
clear designated subjects adult education teaching credential.
This bill would repeal that provision.
Existing law requires a local governing board to use specified
funds to ensure that each pupil is provided with a standards-aligned
textbook or basic instructional materials by the beginning of the
first school term that commences no later than 24 months after those
materials were adopted by the State Board of Education.
This bill would allow a local governing board to also use this
funding to purchase technology-based instructional materials. This
bill would also make several technical, nonsubstantive changes to
these provisions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 44260.2 of the
Education Code is amended to read:
44260.2. The minimum requirements for the three-year primary
designated subjects preliminary adult
education teaching credential shall be all of the following:
(a) Five years or the equivalent of appropriate experience or
education in the subject named on the credential.
(a) For nonacademic subjects:
(1) Three years of adequate, successful, and recent experience in,
or a combination of experience and education in, the nonacademic
subject to be named on the credential.
(b)
(2) Possession of a high school diploma or the passage
of an equivalency examination as designated by the commission.
(b) For academic subjects:
(1) A baccalaureate or higher degree from a regionally accredited
institution of postsecondary education that includes a minimum of 20
semester units, or the equivalent quarter units, of coursework in the
subject to be named on the credential.
(2) Passage of the state basic skills requirement pursuant to
Sections 44252 and 44252.5.
(c) Completion of two semester units or passage of an examination
on the principles and provisions of the United States Constitution,
as specified in Section 44335.
(c) Satisfaction of the requirements for teacher fitness pursuant
to Sections 44339, 44340, and 44341.
(d) Passage of an approved examination of basic reading, writing,
and mathematics skills, as specified in Sections 44252 and 44253.
SEC. 2. Section 44260.3 of the
Education Code is amended to read:
44260.3. The minimum requirements for the five-year
renewal of the preliminary clear designated
subjects adult education teaching credential shall be all of the
following:
(a) A valid three-year preliminary designated subjects
preliminary adult education teaching credential.
(b) Two years of successful teaching, or the equivalent, as
authorized by the preliminary designated subjects
preliminary adult education teaching credential.
(c) A program of personalized preparation as approved by the
commission.
(d) Completion of a program of study in health education,
including, but not limited to, training in, or verification of
training in, cardiopulmonary resuscitation which meets the standards
set by the American Heart Association or the American Red Cross and
emphasis on the physiological and sociological effects of abuse of
alcohol, narcotics, and drugs, and of the use of tobacco.
(d) The study of health education as specified in subparagraph (A)
of paragraph (4) of subdivision (c) of Section 44259.
(e) Completion of two semester units or passage of an examination
on the principles and provisions of the United States Constitution,
as specified in Section 44335.
(f) The study of computer-based technology, including the uses of
technology in educational settings.
SEC. 3. Section 44260.8 of the
Education Code is repealed.
44260.8. (a) The minimum requirements for the clear designated
subjects adult education teaching credential shall include the study
of health education as specified in subparagraph (A) of paragraph (4)
of subdivision (c) of Section 44259.
(b) The minimum requirements for the clear designated subjects
adult education teaching credential shall include study of
computer-based technology, including the uses of technology in
educational settings.
SECTION 1. Section 60422 of the Education Code
is amended to read:
60422. (a) A local governing board shall use funding received
pursuant to this chapter to ensure that each pupil is provided with a
standards-aligned textbook or basic instructional materials, as
adopted by the state board subsequent to the adoption of content
standards pursuant to Section 60605 for kindergarten and grades 1 to
8, inclusive, or as adopted by the local governing board pursuant to
Sections 60400 and 60411, for grades 9 to 12, inclusive. Pupils shall
be provided with standards-aligned textbooks or basic instructional
materials by the beginning of the first school term that commences no
later than 24 months after those materials were adopted by the state
board.
(b) Notwithstanding any other law, a local governing board may use
funding received pursuant to this chapter to purchase
technology-based instructional materials.
(c) Once a governing board certifies compliance with subdivision
(a) with regard to standards-aligned instructional materials in the
core curriculum areas of reading/language arts, mathematics, science,
and history/social sciences, and if the governing board of a school
district has met the eligibility requirements of Section 60119, the
remaining funds may only be used consistent with subdivision (a) of
Section 60242 and pursuant to Section 60242.5.
(d) The state board may grant the school district additional time
to meet the purchasing requirements of subdivision (a) if the
governing board of the school district demonstrates, to the
satisfaction of the state board, that all of the following criteria
apply to the district:
(1) The school district has implemented a well-designed,
standards-aligned basic instructional materials program.
(2) The school district, at the time of its request for additional
time pursuant to this subdivision, has sufficient textbooks or basic
instructional materials for use by each pupil.
(3) The school district has adopted a plan for the purchase of
standards-aligned instructional materials in accordance with
subdivision (a) that indicated an alternative date for compliance
that is declared in the request for additional time.
(e) The funds provided for the purchase of instructional materials
in Schedules 1 and 2 of Item 6110-189-0001 and paragraph 6 of Item
6110-485 of Section 2.00 of the Budget Act of 2002 (Chapter 379 of
the Statutes of 2002) shall be used for the purposes of, and
allocated consistent with, this chapter.
