           SUMMARY  

          This bill clarifies provisions established by SB 443 (Migden),  
          Chapter 443, Statutes of 2007. SB 443 authorized the use of  
          reproductive technologies to reduce the risk of HIV infection in  
          couples where one partner is HIV-positive (HIV-discordant  
          couples). Specifically, this bill: 

          1)Deletes a requirement for the Department of Public Health to  
            adopt regulations. 

          2)Deletes several provider requirements with regard to treatment  
            and notification.

          3)Makes other clarifying changes to ease implementation and  
            oversight. 

           FISCAL EFFECT  

          No direct fiscal impact to DPH to continue oversight of medical  
          professionals providing reproductive technologies to  
          HIV-discordant couples. 

           COMMENTS  

           Rationale  . This bill is sponsored by the American Society of  
          Reproductive Technology to clarify provisions of SB 443 which  
          was enacted to increase the reproductive choices for couples  
          where one member of the couple is HIV-infected. SB 443 created a  
          process by which such sperm may be used if subjected to  
          "washing." Sperm washing is a procedure used to reduce the  
          likelihood of passing disease via conception. Sperm are  
          separated from the surrounding seminal fluid by a centrifuge and

          then washed in an infection-removing solution. This bill makes  
          several clarifying changes to these provisions to ease  
          implementation and oversight.
