BILL SUMMARY: AB 1439 adds a new section to the Penal Code
requiring the Director of the Office of Gang and Youth Violence
Policy (OGYVP) to convene a working group, consisting of
specified members, to create recommendations for consolidating
and streamlining existing gang and youth violence programs. This
bill requires the working group to convene by March 1, 2010, and
to submit a specified report to the Legislature on or before
June 1, 2010.

*If the bill specifies that OGYVP is responsible for the report,
the costs are very minor and absorbable. As written, 14 agencies
and departments with varied funding sources are responsible for
the report, and there will likely be minor costs to those
departments.

STAFF COMMENTS: This bill requires OGYVP to convene a specified
working group, and to make formal recommendations to the
Legislature regarding consolidation and streamlining of the
state many gang and youth violence programs and, in the case of
grant programs, their application processes.
The working group required by this bill already exists and has
met to discuss the issues prescribed in the bill. Convening this
group and facilitating these types of discussions falls within
the mission and practice of OGYVP. Functionally, this bill
directs the working group to continue to meet, and to develop
and report their recommendations by June 1, 2010.
Staff recommends that the bill be amended to specify that OGYVP
is responsible for preparing, and submitting to the legislature,
the working group's findings and recommendations. Additionally,
the bill should specify that nothing in this section requires
the other stakeholders in the working group to participate in
the preparation of a final report to the Legislature.
OGYVP has indicated that it is capable of preparing and
submitting the specified report to the Legislature, without
additional resources, by the specified deadline.
