CONCURRENCE IN SENATE AMENDMENTS

SUMMARY : Makes several changes to update, correct and improve
the Fish and Game Code (FGC), and makes technical corrections to
the Government Code.
The Senate amendments add the following:
1)Authorize the Department of Fish and Game (DFG) to enter into
reciprocal operational agreements with representatives from
state law enforcement agencies in Oregon, Nevada and Arizona,
to promote effective enforcement of fish and game laws in
areas adjacent to the borders of these adjoining states.
2)Authorize DFG to issue collectible commemorative hunting and
fishing licenses to support hunting and fishing and resource
conservation.
3)Authorize DFG to sell voluntary warden stamps to support fish
and game wardens. Prohibit any license or permit from
indicating that a warden stamp has been purchased.
4)Clarify it is unlawful to violate fish and game regulations
adopted by DFG or the Fish and Game Commission.
5)Authorize DFG, after expiration of the time period for appeal,
to apply to a court for a judgment to collect currently
authorized civil penalties.
6)Extend the sunset date from 2010 to 2013 for several sections
of law relating to Dungeness crab.
7)Extend the sunset date from 2010 to 2015 for an existing
program on wetland mitigation banks.

8)Delete proposed amendments to existing law relating to fishing
and hunting derbies.
9)Make other technical changes.
EXISTING LAW , pursuant to FGC, contains numerous provisions
governing the taking, management and protection of fish and
wildlife in the State. DFG is charged with implementing and
enforcing the provisions of the FGC.
AS PASSED BY THE ASSEMBLY , this bill made numerous changes to
update and improve the FGC. The Senate version retains most of
the provisions included in the Assembly version, and adds the
additional changes as described above.
FISCAL EFFECT : According to the Senate Appropriations
Committee, unknown minor revenue increases from sale of
voluntary stamps and commemorative licenses; and minor revenue
costs from extension of existing programs, ranging from $20,000
in 2009-10 to $223,000 in 2011-12 (Fish and Game Preservation
Fund).
COMMENTS : This measure is an omnibus committee bill, the
purpose of which is to update and improve the FGC, to assist the
state in managing natural resources and to make technical
corrections. Among other things, this bill authorizes DFG to
seek and accept donations for its Canine (K9) program,
authorizes county officials to take certain mammals involved in
dangerous disease outbreaks upon the approval of and in the
manner approved by DFG, clarifies when a fish wholesaler's or
fish importer's license is required, extends the sunset on
several provisions of existing law relating to Dungeness crab,
sea cucumbers, and wetlands mitigation banks that would
otherwise sunset after this year, authorizes derby contests for
fishing to also apply to other game species, and authorizes DFG
to waive the permit fee if the primary purpose of the derby is
to educate young persons about fishing or hunting. Several of
the provisions added in the Senate were previously contained in
AB 1443 (Committee on Water, Parks & Wildlife) which passed the
Assembly on consent.
