SUMMARY
This bill authorizes a non-California resident parent, spouse,
or guardian on active United State military service in
California to supervise the required 50 hours of driving
practice for a minor driving with an instruction permit,
accompany a minor driving with a provisional drivers license,
and to accept civil liability for a minor applying for a
driver's license.
FISCAL EFFECT
Minor and absorbable costs to DMV.
COMMENTS
1)Background . Drivers between 15 and 18 years of age are
subject to California's provisional driver's licensing
program. This graduated program requires completion of
specified educational requirements, behind-the-wheel
instruction, and a minimum of 50 hours of supervised practice
with no less than 10 hours of night driving, upon which the
person may submit to a driving examination conducted by an
examiner of DMV. The practice must be supervised by a
California-licensed driver 25 years of age or older. Non
residents that are exempt from California's licensing
requirements are prohibited from certifying the training of
his or her child.
Civil liability provision of current law require that a
minor's application for a driver's license be signed or
verified by a person residing in California who has custody of

the minor.
2)Purpose . This bill is intended to address a problem that
arises when parents on military duty in California that are
legal residents of another state are prohibited from
supervising and taking civil responsibility for their child's
driving.
