DESCRIPTION
Current law authorizes nonprofit charitable organizations to
receive donated electric commodity service through a direct
transmission with an electric service provider if electric
commodity service is donated free of charge without
compensation.
This bill extends the sunset on that authorization until January
1, 2012.
Current law defines "retail seller" as an entity engaged in the
retail sale of electricity to end-use customers located within
the state including electrical corporations, community choice
aggregators and electric service providers.
This bill replaces the term "retail supplier" with "retail
seller," replaces the term "eligible renewals" with "eligible
renewable energy resources," and incorporates definitions for
those terms that are applicable to the California Renewables
Portfolio Standard Program.
This bill replaces the term "California Energy Resources
Conservation and Development Commission" with "Energy
Commission.
BACKGROUND
This bill is a committee cleanup bill.
COMMENTS
1) Nonprofit Charitable Organization . The section of this
bill that extends the sunset date of current law
authorizing a nonprofit charitable organization to acquire
electric commodity service has been superseded by SB 176
(Ch. 36, Stats. 2009), which extended the sunset date from
January 1, 2010, to January 1, 2015. Accordingly, the
author may wish to consider deleting this provision.
2) Technical Changes . All the other provisions of this
bill are intended to make minor technical changes to
definitions in order to clarify code pertaining to
utilities and renewable energy. All of the provisions are
nonsubstantive and without opposition. In addition, the
relevant regulatory agencies have been consulted and have
expressed no concerns. As the code cleanup bill, the bill
does not and will not contain any section to which any
party objects.
