CONCURRENCE IN SENATE AMENDMENTS

SUMMARY : Extends the sunset date of the Structural Fumigation
Enforcement Program (SFEP) to January 1, 2014.
The Senate amendments :
1)Make the following changes to the Structural Pest Control
Board (SPCB):
a) Revise the number of licensed pest control operators the
Governor may appoint from two to three; and,
b) Require the Department of Pesticide Regulation (DPR) to
solicit nominations from interested parties via mail and
DPR's Internet Web sites 60 days prior to the Governor's
appointment. Requires nominations to be made in writing,
include specified information, be mailed to DPR, and made
available to the Governor and the DPR director.
2)Authorize, instead of require, the Los Angeles County
Agricultural Commissioner, the Orange County Agricultural
Commissioner, the Santa Clara County Agricultural
Commissioner, and the San Diego County Agricultural
Commissioner to perform increased structural fumigation,
inspection, and enforcement.
1)Make technical and clarifying amendments.
EXISTING LAW :
1)Authorizes the Los Angeles County Agricultural Commissioner,
the Orange County Agricultural Commissioner, the Santa Clara

County Agricultural Commissioner, and the San Diego County
Agricultural Commissioner to contract with the DPR to perform
increased structural fumigation, inspection, and enforcement
activities.
2)Requires an individual who performs a structural fumigation
treatment in the SFEP, to pay the county agricultural
commissioner a fee of $5 for each treatment conducted at a
specific building or structure.
3)Sunsets the SFEP on January 1, 2011.
AS PASSED BY THE ASSEMBLY , this bill extends the sunset date of
the SFEP to January 1, 2014.
FISCAL EFFECT : Unknown. This bill is keyed non-fiscal.
COMMENTS : This bill was amended in the Senate to address SPCB's
transition from the Department of Consumer Affairs to the DPR in
the 2009-10 Budget Act and revises the SPCB appointment process.
This bill, as amended in the Senate is consistent with Assembly
actions.
