          BILL SUMMARY:   AB 2089 would extend the sunset date of the  
          California American Indian Education Center program until  
          January 1, 2017, and would require the Department of Education  
          to evaluate program results and make recommendations for  
          improvement by January 1, 2016.  The bill would also allow the  
          Superintendent of Public Instruction more options for filling  
          vacancies modify on the American Indian Education Oversight  
          Committee, as specified.

          STAFF COMMENTS: SUSPENSE FILE.

          Current law:  

                 Establishes the California American Indian Education  
               Center (CAIEC) program to serve as community-based  
               educational resource centers to American Indian pupils,  
               parents, guardians, and public schools in order to promote  
               the academic and cultural achievement of American Indian  
               pupils.  
                 Requires each center to annually submit a report to the  
               CDE that includes appropriate data that reflects each  
               center's ability to meet stated objectives, measure pupil  
               academic performance, and meet the continued educational  
               and cultural needs of the community.  










                 Requires the Department of Education (CDE) to evaluate  
               the centers to determine whether to renew the application  
               of each existing center or instead to approve a new center.  
                
                 Requires CDE, by January 1, 2011, to report consolidated  
               results for all centers and supply information that is  
               required for a comprehensive evaluation of those results,  
               and make recommendations for program improvement.
                 Requires the Superintendent of Public Instruction (SPI)  
               to appoint an American Indian Education Oversight Committee  
               (oversight committee) for the purpose of providing input  
               and advice to the SPI on all aspects of American Indian  
               education programs established by the state.  The  
               membership of the oversight committee is to include at  
               least seven educators, four of whom must be center  
               directors, and

                 requires all members to have proven knowledge of current  
               educational policies relating to, and issues faced by,  
               American Indian communities in California.
          
          Authority for the CAIEC program sunsets on January 1, 2012.

          This bill would reauthorize the CAIEC program for an additional  
          five years and require CDE to provide an evaluation, as  
          specified, by January 0f 2016.  The bill would further authorize  
          the SPI to appoint to the CAIEC Committee an educator that is  
          not a center director to fill a vacancy in one of the four  
          positions designated for center directors, if the SPI is unable  
          to find a qualified individual to fill a vacancy within 30 days  
          of the vacancy arising.  Apparently, the committee has had  
          difficulty filling vacant positions, so this provision is  
          intended to expand the pool of eligible members so that the  
          committee may complete its functions.

          The amount proposed in the 2010-11 budget for the program, which  
          supports 27 centers, is approximately $3.6 million, so extending  
          the program will likely result in similar annual costs for an  
          additional five years.  Staff costs in support of the program  
          are $300,000, annually, and the Department estimates a cost of  
          $60,000 for the report.  Staff further notes that these funds  
          are subject to flexibility provisions approved by SBX3 4 (2009),  
          so these funds can be expended by local education agencies for  










          any educational purpose through the 2012-13 fiscal year.
