          CONCURRENCE IN SENATE AMENDMENTS

           SUMMARY  :  Abolishes the Joint Committee on Boards, Commissions,  
          and Consumer Protection (Joint Committee) and makes eligible  
          agencies subject to review by the new Joint Sunset Review  
          Committee (JSRC) created by the companion measure AB 1659  
          (Huber).

           The Senate amendments  recast the Assembly version of the bill  
          to:

          1)Abolish the Joint Committee and its authority to review all  
            existing boards and other entities every four years and delete  
            provisions of law related to the sunset review process.

          2)Repeal provisions of law allowing boards subject to sunset  
            review to become bureaus under the Department of Consumer  
            Affairs (DCA) upon becoming inoperative or being repealed.

          3)Make instead all "eligible agencies," as defined, subject to  
            review by the JSRC which would be established pursuant to AB  
            1659 (Huber).

          4)Add a sunset date of January 1, 2013, to the following:

            a)   The State Race Track Leasing Commission;

            b)   The Capitol Area Committee;

            c)   The Continuing Care Advisory Committee; and,

            d)   The California Recreational Trails Committee. 

          5)Provide that the JSRC shall make a report available to the  
            public and the Legislature on whether an agency should be

            terminated, or continued, or whether its functions should be  
            revised or consolidated with those of another agency, and  
            include any other recommendations as necessary to improve the  
            effectiveness and efficiency of the agency.

          6)Provide that if the JSRC deems it advisable, the report may  
            include proposed legislation to carry out its recommendations.

          7)Specify that the provisions of this measure would not become  
            operative unless AB 1659 is enacted and establishes the JSRC.

          8)Make conforming changes.


           
          EXISTING LAW  :

          1)Establishes sunset dates on boards under DCA.

          2)Establishes the Joint Committee to hold public hearings at  
            specified times and to evaluate whether a board or regulatory  
            program has demonstrated a need for its continued existence.

          3)States legislative intent that all existing and proposed state  
            boards are subject to review every four years to evaluate and  
            determine whether each has demonstrated a public need for its  
            continued existence, as specified.

           AS PASSED BY THE ASSEMBLY  , this bill eliminated the Joint  
          Committee and replaced it with the JSRC, and required boards and  
          bureaus within DCA that already contain a sunset date to be  
          reviewed by the JSRC, rather than the Joint Committee.  This  
          bill is substantially similar to the version approved by the  
          Senate.

           FISCAL EFFECT  :  According to the Senate Appropriations  
          Committee, pursuant to Senate Rule 28.8, negligible state costs.
